II. General Terms of Use

The use of the site and the sale of products offered on larianna.it are governed by these General Terms of Use of larianna.it ("General Terms of Use"). By using larianna.it, the user expressly declares to have read, understood and accepted without reservation these General Terms of Use. By using larianna.it, the user also accepts the privacy clauses of L'ARIANNA.IT (see "Security and Privacy"). TONYMAN SRL may at any time modify and update these General Terms of Use and the Privacy and Cookie Policies. The General Terms of Use and Privacy and Cookie Policies applicable to the user are those in force at the time of use of larianna.it. We therefore invite the user to periodically consult the currently applicable conditions. 1. Security and Privacy

The Privacy and Cookie Policies govern the use of personal data that the user agrees to provide to TONYMAN SRL on this site. TONYMAN SRL may at any time modify the Privacy and Cookie Policies as set out in this document. The use of larianna.it is not intended for minors.

2. Intellectual Property

2.1 The Site

Therefore, unless expressly stated otherwise, the intellectual property rights to documents and data contained in the Site as well as to each of the constituent elements of the Site (images, illustrations, audio, graphic elements, notices, etc.), including software, databases and newsletters, are the exclusive property of TONYMAN SRL (hereinafter "Content"), which grants no licence or other right except to consult the Site. TONYMAN SRL reserves the right to claim damages in the event of counterfeiting and, more generally, infringement of its intellectual property rights. Similarly, the user undertakes not to infringe the property rights, and in particular the intellectual property rights, of all companies in the group to which TONYMAN SRL belongs. TONYMAN SRL's partners own their trademarks. Any use of such trademarks and/or logos and/or any other content is subject to the explicit authorisation of TONYMAN SRL or the holder of the relevant intellectual property rights.

Since TONYMAN SRL has no control over such external sites and sources, it cannot be held responsible for making such sites or external sources available and disclaims all liability relating to the content, advertising, products, services and any other material available on or arising from such sites and external sources. Furthermore, TONYMAN SRL cannot be held responsible for any damage or loss, actual or consequential, arising from the use of or reliance on the content, products or services available on such sites or external sources. The user uses the Site at their own risk. TONYMAN SRL shall not under any circumstances be held liable to the user or to third parties for any indirect, incidental or consequential damages — including, without limitation, loss of profits or other indirect losses — arising from or related to the user's use of or inability to use larianna.it. This limitation of liability applies to the extent permitted by law.

TONYMAN SRL cannot guarantee or declare:
— that larianna.it is free from viruses, worms, trojans or other harmful material;

The site larianna.it may contain technical inaccuracies or other functional defects; TONYMAN SRL does not guarantee the correction of such defects. The site L'ARIANNA.it and its contents are presented "as is" and "as available". TONYMAN SRL makes no warranties of any kind and, in particular, no implied warranties as to the conformity or suitability of larianna.it for normal use or for a specific purpose, or as to the quality or absence of violations of any provision. Each user is required to use the Internet responsibly and in respect of the rights of other users.

— transmit or transfer (by any means) information or software derived from the Site, in particular to foreign countries in violation of national and international laws.
Acknowledging the global reach of the Internet, the User undertakes to comply with all applicable local and international rules and procedures regarding online conduct, permitted content and in particular the rules applicable to the transmission of technical data. TONYMAN SRL may, at any time, for any reason and without notice, take all necessary steps to terminate the use of the Site or any other service for any violation of the Terms of Use, without prejudice to TONYMAN SRL's right to seek compensation for any damages connected to such violation.

6. Governing Law and Disputes

These General Terms of Use are governed by and construed in accordance with Italian law pursuant to EC Regulation 593/2008 of 17 June 2008. In the event of a dispute related to the use of the Site, the user may resort to a conventional mediation procedure or any alternative dispute resolution procedure.

In the event of a dispute, in accordance with the provisions of Regulation No. 44/2001 of 22 December 2000:

— the user may bring proceedings before the court of their place of domicile or before the Italian courts;

— TONYMAN SRL may bring proceedings before the court of the user's place of domicile.

TONYMAN SRL reserves the right to seek and obtain injunctions or orders in defence of its rights under these General Terms of Use. Should any provision of these Terms of Use be found void by a competent court, the invalidity of that provision shall not affect the validity of the remaining provisions of these General Terms of Use, which shall remain in full force and effect. Any waiver of any right shall not in any way be deemed a future or continuing waiver of that provision or of any other provision. To the extent permitted by applicable law, both parties agree that any action relating to the Site must be commenced within one year of the appearance of the cause of action. Failing this, it shall be definitively rejected. We therefore invite the user to periodically consult the currently applicable conditions.

7. Right of Withdrawal (EU Consumers)

Under EU Directive 2023/2673, transposed into Italian law by Legislative Decree 209/2025, the Customer consumer has the right to withdraw from the purchase contract within 14 days from the delivery of the last item in the order, without providing any reason and without any penalty.

How to exercise the right of withdrawal

The right of withdrawal may be exercised at any time before delivery (cancellation) or within 14 days of delivery, directly from the customer area at account.larianna.it or by sending written notice to shop@larianna.it.

Refund

Following withdrawal, we will refund all payments received, including the original shipping costs (except for any additional costs arising from a choice of delivery method other than the standard option), within 14 days of receiving the returned goods or proof of return. The refund will be made using the same payment method used for the purchase.
